1. What Lucy Is (and Isn't)

Lucy is an AI companion application designed to provide conversational companionship with persistent memory and emotional intelligence. Lucy remembers your conversations, learns your preferences, and responds with warmth and personality.

Lucy is not a replacement for professional help. Lucy is not a therapist, counselor, medical professional, or crisis service. She does not provide medical, legal, financial, or psychological advice. If you are experiencing a mental health crisis or emergency, please contact your local emergency services or a qualified professional immediately.

Lucy is designed to complement your existing relationships and support systems, not replace them.

2. Eligibility

You must be at least 16 years old to use Lucy. By creating an account, you confirm that you meet this age requirement. If we learn that a user is under 16, we will terminate their account and delete all associated data.

3. Your Account

You are responsible for maintaining the security of your account credentials. You agree to:

• Provide accurate information when creating your account
• Keep your login credentials secure and confidential
• Notify us immediately if you suspect unauthorized access to your account

You are responsible for all activity that occurs under your account.

4. Subscription and Payment

4.1 Pricing

Lucy is available as a monthly subscription at the price displayed at the time of purchase. The subscription includes full access to all features with no limitations or upsells.

4.2 Free Trial

New users receive a 7-day free trial. No payment information is required to start the trial. At the end of the trial, you may choose to subscribe or your access will end.

4.3 Billing

Subscriptions are billed monthly through your app store (Apple App Store or Google Play). Billing is managed by the respective platform according to their terms.

4.4 Cancellation

You may cancel your subscription at any time through your app store's subscription management. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then.

4.5 After Cancellation

After your subscription ends, your data remains stored and accessible for export for 90 days. We will notify you before any data is permanently deleted.

5. Acceptable Use

You agree to use Lucy in a manner consistent with its intended purpose as a conversational companion. You may not:

• Use Lucy to generate content that is illegal, harmful, abusive, or threatening
• Attempt to extract, reverse-engineer, or replicate Lucy's AI models or proprietary systems
• Use automated tools, bots, or scripts to interact with Lucy
• Share your account credentials with others or allow multiple people to use a single account
• Use Lucy for any commercial purpose, including but not limited to reselling access or generating content for commercial use
• Attempt to circumvent any security measures or usage limits

We reserve the right to suspend or terminate accounts that violate these terms.

6. Your Content and Data

You own your content. Everything you share with Lucy remains yours. We do not claim any ownership or intellectual property rights over your conversations or any content you create through the Service.

By using the Service, you grant us a limited license to process your content solely for the purpose of providing and improving the Service. This processing includes generating Lucy's responses and maintaining her memory of your conversations.

7. Our Intellectual Property

The Service, including Lucy's personality, response generation systems, memory architecture, user interface, branding, and all associated technology, is owned by Lucy AI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service.

8. Service Availability

We strive to keep Lucy available and responsive at all times, but we cannot guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we permanently discontinue the Service, we will provide at least 60 days' notice and ensure you can export your data before shutdown.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Lucy is an AI system. While we strive for accuracy and emotional sensitivity, Lucy may occasionally:

• Misunderstand the context or tone of your messages
• Provide information that is inaccurate or incomplete
• Respond in unexpected or imperfect ways

Lucy's responses should not be relied upon as factual statements, professional advice, or guidance for important decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Lucy AI and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any content generated by Lucy
• Unauthorized access to your account or data
• Any interruption or cessation of the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Lucy AI, its founders, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Slovenia.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
